Dancing Tot Wins

Discussion in 'NZ Computing' started by Lawrence D'Oliveiro, Mar 2, 2010.

  1. A few years ago, Stephanie Lenz put up a video on YouTube showing her little
child dancing, with Prince’s “Let’s Go Crazy†playing in the background.
Universal sent a DMCA takedown notice, but the EFF came to Lenz’s defence,
    citing fair use.

Now, a judge has granted a partial summary judgement in favour of Lenz. In
particular, the judge rejected Universal’s argument that it was
“unreasonable†to expect the content owner to take fair use into account
before issuing a takedown. So Lenz gets to recover attorneys’ fees incurred
from her initial case against the takedown.
