ACTA Treaty Analysis Leaked

    EU analysis of the provisions of the ACTA treaty have been released to
    the web.

    Proposed treaty extends to all digital media- not just online.
    Enforcement procedures shall be "effective" (no requirement for fairness,
    justice or equity; so almost surely a breach of the NZ Bill Of Rights if
    implemented).

    There appears to be no recognition of "fair Dealing for private study or
    research". Breach of Technical Protection Measures would be a criminal
    and civil offence in itself and the requirement for there to be an intent
    to breach copyright would go. Our current copyright law allows breaking
    of TPM by libraries etc. where necessary for archival purposes and format
    shifting for interoperability is also allowed. The Commerce Commission
    has stated that it considers region protection on DVD's sold in NZ to be
    a restrictive trade practice within the meaning of the Fair Trade Act.
    This is an attempt to push the American DMCA out into the international
    community.

    It would be nice to have the actual wording of the proposed treaty but
    that still seems to be a secret.
