Quite right.
The really REAl Hummingbird posted on alt.comp.freeware (until he went
off to do some business) owns two of the images that the socialist
"jak bute" has stolen and is now claiming as his own but is bellyaching
about missing EXIF data. HB's originals probably still contain the EXIF
data.

Thank you for your support, ART. As you say I am the REAL hummingbird.

All 3 of my pictures belong to me. They were stolen by thieves who
hacked my server when I invited them to look at my photos. I've now
decided I didn't want them to see my pictures.

Before you ask, I have never been to the Duangjitt Hotel in Patong in
2007. I never wrote in their guestbook:

"I enjoyed this hotel enormously. A fabulous place to stay with
incredible tropical garden and two swimming pools. All I have
left now are the dreams of paradise! Highly recommended. I hope
to go there again in early 2008."

Please define "steal" in this circumstance:

Did they copy your files from your server, leaving the originals alone?
If so then you have the originals and presumably any EXIF data they
originally had.

Did they copy your files and then _delete_ them from your server? If so
are they on a recent backup -- presumably with data intact?

Did they copy your files and then _delete_ them from your server _and_
you have no backup? That would put you in SOL territory.

Do you have the originals safe but want to prevent the copies'
unauthorized use? Then you have a case against the hosting sites they
used, who should immediately remove them from _their_ servers.

Do you want to prevent them from posting the files anywhere else? That's
tricky since they could be anywhere. Using a service such as Digimark,
which watermarks and tracks photos for copyright reasons, would be a
reasonable expense.

Unfortunately the people who misappropriated your images have digital
files now, and you have no way to directly control what they do with
them. Retaining an attorney and sending "cease-and-desist" letters to
the purloiners and the hosting sites they use may be your only recourse
(to be followed up with at least the threat of a lawsuit).

No, but the pertinent part that you snipped does have to do with what
the OP said, viz.

As in if someone copies a digital photo of a tree falling in the forest
but leaves the original behind, is that more or less like stealing than
(essentially) using it without permission? There is a difference in
fact, tho' I suppose the law depends on the jurisdiction.

I already have a lovely bridge -- but you know, it's never too late to
start a really good bridge collection, so I'm making you his one-time
offer to buy the bridge of your dreams _and_ be the first one on your
block with two bridges.

You could then be called Sir Franklin "Two-Bridges" Stubbings...

Franklin, you have finally descended into lunacy.

Your growing number of forged posts tell any alert person what a complete
whacko you are. However much you forge posts in the name of Hummingbird
pretending to be him, you are not and never will be him. You are a simple
fool who has achieved nothing of importance in your dull, miserable life,
and no doubt you will die a very sad specimen of human waste wondering
where it all went wrong.
