Default is this legal?

My Hollywood Video store has recently started renting out Finding Nemo split
up. They've taken the two disc set and split them up and are renting each
separately. Is this legal? I always thought that it was unlawful to profit
on the pieces of a pre-packaged set. An example would be when you buy a bag
of bite-size Snickers, each wrapper says "not for individual sale".

That is a hard one. The 2 disc has separate P&S and WS on each disc so
it's easy to rent disc 1 to WS fan and disc 2 to P&S fan. Special
features are different though.

Maybe you should check with Disney and see what they think?

Legal or not, I wouldn't patronize a store that breaks up 'single' releases.
I hope you have another place to rent from.

Is it any different then renting the individual disks from a box set?
The local Blockbusters has shows like Band of Brothers, Sopranos, etc
with each disk a separate rental.

I would say it is, but only because they don't want to have to charge you for
renting an entire 6 disc set as apposed to 'Nemo'... it's crappy business to
break up the 'Nemo" based on the extras factor though... that's like splitting
an Oreo with a friend - Someone gets more creme filling than the other.

On another thread, someone posted that rental stores are getting tired of the
damage done to DVDs by renters (why this happens I will never know, but I guess
it's an epidemic of some sort) saying that on average they get three rentals
out of the DVD before it needs to be replaced due to damage... could be
Hollywood Video saw an op to save a little cake on their bulk investment of
'Nemo'.

sure it's legal. You can sell bite ize candy individually, too. But the
candy company will come after you if they find out.

Our local video stores rent TV series DVDs individually.

Of course, for renting a 6 disc set it costs around $20, almost cheaper
to buy the set in some cases.

Doesn't Netflix seperate discs?

It's the same as any rental item. "It's not mine so I don't care how
shitty I treat it"

But what's worse as far as I'm concerned is that a lot of stores
(around here, anyway) apparently don't even bother to try to clean the
discs after they've been returned. I've rented I don't know how many
movies and games that look like they've been plastered to the ceiling
with peanut butter and are still coated with residue or giant greasy
fingerprints.

Some packages say the you're not to sell items individually, but I've
always figured that's because the smaller items aren't labled
correctly. There's nothing on a DVD package that says "discs not to be
sold or rented individually"
