ENERGIS ABUSE TICKET : 1636944 Inappropriate Usenet Posting - ?????

Have just received the following email:

Re: Inappropriate Usenet Posting

Energis is a backbone ISP. We host virtual ISPs including Wanadoo and LUFC.
This means that we own the network on which your account is hosted. We
therefore have an obligation to deal with abuse issues relating to our
network.

We have received a complaint about an inappropriate usenet Posting(s)
originating from your account. The headers of the posting are included below
and trace back to your account. The posting in question (included below) may
be Unsolicited Commercial Email (UCE), off-topic or against the newsgroup
charter and therefore is in breach of the Terms of Use that you accepted
upon sign-up. We have noted receipt of this report on your account log.

If further complaints are received we shall at our discretion take
appropriate action. This may lead to your account being locked.

Before posting on newsgroups, it is important to first understand the
rules. You
need to read the postings to get a feel for the newsgroup and also read the
FAQs and the charter.

Should I take it seriously. The email in question was one about posting
using PowerPost2000 and reposting missing segments.

With no use of bad language, and being obviously ON topic, any idea as to
what I should do.

I'm confused.

They probably never read it as they are snowed under with work.

Glance at it, Press Button C. (General Abuse Caution)

It may be logged to your account record. Better to try and get it
removed now, rather than later.

I just don't get why someone has reported me. I didn't direct abuse at
anyone. My question about PowerPOst WAS on topic. And I wasn't after any
money. The ENERGIS email didn't even tell me what offense I had caused, what
'law' I'd broken. I just hoped this was a hoax type email, now by the looks
of things it ain't and I'm most concerned. Hopefully my email to ENERGIS
will get them to explain a bit clearer as to what I did wrong

Hard to offer advice without the Message-ID in question (looks like you
snipped it out). If you had included it, we might have been able to
suggest where you allegedly went wrong.

I use PP2K to post largish (~7MB) files to newsgroups.

PP2K splits the file into a number of segments, which both my newsreaders,
Outlook Express (nonyenc) and Ozum (yenc) lists as shown below

Track01.mp3 (1/6)
Track01.mp3 (2/6)
Track01.mp3 (3/6)
Track01.mp3 (4/6)
Track01.mp3 (5/6)
Track01.mp3 (6/6)

If anyone who wants this file sees they are missing a segment I can easily
repost the missing one - PP2K makes this v. easy.

My problem is this. I keep getting request from people saying the file has
arrived incomplete to their server and they want the WHOLE file reposted.
They don't ask for the missing segments, rather they want the whole thing.

My only experience with newsgroup-readers is with my 2 above, so my question
is this. Are there some news-readers out there that given an incomplete file
then me reposting the missing segment won't fix it for them?

I know (I think) that some newsreaders do not list all available segments.
And when there is an incomplete file put out something like [incomplete
file, missing segments 2,3,4]. Would reposting these missing segments fix
the file, and in so doing remove the error message ??

Can someone with some knowledge please assist.

IMO, the complaint is completely unfounded.

(1) Not UCE (spam)
(2) 24hs.hd has *no* topic
(3) 24hs.hd has no official charter

Had your ISP actually read your post, instead of sending this amateurish
knee-jerk automated response, they would know this.

Incidentally, any ISP that treats its customers like this doesn't
deserve your business.

Obviously, someone is screwing with you. If you ever find out who
reported you, report them, in turn, to their ISP. This is harassment
and should be against most Terms of Service.

But, do followup with your ISP to have your record cleared, in the
interim. Record -- Ha! Feeling like a criminal, yet? }:O)

Demand an apology, in writing. Then go ISP shopping. If and when you
cancel your service, make sure you tell them why.

You wont get anything out of them except autometed emails and an answering
machine. Just let it go.

It took about 2hours but they did ring me back.

It seems my return-email address of (E-Mail Removed) was the cause of all
the problems.

It isn't / wasn't my REAL address, only something that sounded nice.

Either someone with the actual domain name of night.com has seen my messages
and complained I'm using their name. (though didn't think of replying within
the group to tell me)

OR someone dodil with nothing better to do thought they might as well report
me rather than reply to my 'PowerPost' email and tell me I could be causing
someoneelse problems with my chosen email address.

All I wanted was to avoid spam, and to not have a displayed email address
like (E-Mail Removed) .

Maybe I could use (E-Mail Removed) and see if that causes any problems. But
on reflection that would be a BAD thing to do. So I won't.

The complaint was centred around my chosen email address. Seems the
nark/grass ( technical term for a self-designated net-policeman ) reported
me as someone possibly causing the real owner of night.com to receive
unasked for spam.

The fact that ENERGIS didn't tell me the nature of the complaint was, in
their words, a little oversight !!

I only used that (evil) mail address to avoid spam and people writing to me
directly rather than thru the newsgroup - I was after a little assistance,
not a life long friend !!!!!
And also cos it sounds nice.

So I guess I must change it.
